Case C-246/07 Commission v. Sweden and the duty of cooperation in EU External Relations

At the seminar Anna Falk, Joni Helikoski and Christophe Hillion will give their views on the recent judgment of the Court of Justice of the EU in the case C-246/07 Commission v. Sweden, which raises important issues concerning the duty of cooperation in EU external relations.

In this case the Court (in full Chamber) and following the complaint of the Commission, declared that by unilaterally proposing that a substance, perfluoroctane sulfonate (‘PFOS’), be added to Annex A to the Stockholm Convention on Persistent Organic Pollutants (‘the Stockholm Convention’) (a mixed agreement), the Kingdom of Sweden failed to fulfil its obligations under Articles 10 EC and 300(1) EC. Anna Falk is Director at the Swedish Ministry for Foreign Affairs.
