At the seminar Jacob Öberg will present his PhD thesis “LIMITS TO EU POWERS: A case study on individual criminal sanctions for the enforcement of EU law”. The thesis focuses on the limits of the exercise of EU competences using EU criminal policy as a case study.
It develops a general framework for testing the legality of EU legislation which is subsequently applied to discrete examples of EU criminal law measures, e.g. in the area of intellectual property law, environmental law and competition law . This examination demonstrates the existence of several important procedural and substantive limitations to the exercise of EU competences.
