What Fundamental Rights Do Companies Enjoy in European Law?" (Oliver); "Equality of Treatment under EU Law: A Case of Double Standards?

den 8 december 2014, kl. 14:00

Concentrating on EU law and the European Convention on Human Rights, Prof. Peter Oliver will consider the fundamental rights which commercial companies currently enjoy, and those which they should enjoy in a variety of fields (e.g. access to justice, property, privacy and freedom of expression).

Some judgments of the US Supreme Court will also be mentioned, and there will also be references to the rights of non-profit entities and individuals acting in a professional or economic capacity. Prof. Watson's seminar will look at the principle of equality of treatment as applied to each of the suspect classes with a view to ascertaining whether there is in fact a difference in levels of protection. If there are differences can they be objectively justified? Can one form of discriminatory conduct be regarded as more pernicious than another?
